Welcome to the website of Arrowform Limited (“Arrowform”). Thank you for taking the time to read these terms and conditions, which apply to your use of our website and our services.

It is important that you read these terms and conditions carefully because by using our website and our services, you will be deemed to have accepted them. We may change these terms and conditions at any time by posting changes online.

Terms

“You” means the person accessing or using the website. “I” and “your” have corresponding meanings.

“Us” means Arrowform Limited, its related companies, successors and assignees. “Arrowform”, “we” and “our” have corresponding meanings.

Authority to Act with the ACC

I authorise Arrowform Limited (trading as Levy Refunds) to act as my agent with the ACC and to carry out procedures and transactions in accordance with this authority, including obtaining information about me from the ACC by whatever means Arrowform considers appropriate. I acknowledge that submitting this application authorises Arrowform to submit an invoice re-assessment application to the ACC to determine whether there are any refunds owed to me.

I understand and accept the terms and conditions upon which Arrowform will provide their services to me as set out at here, and in particular that Arrowform is not liable for actions undertaken by it in connection with the authority contained herein (either direct or indirect). If for any reason a court determines that Arrowform is liable in any way, I agree that the liability of Arrowform is limited to the fee paid by me to Arrowform.

I understand and accept that by providing authority to Arrowform, I am authorising any representative of Arrowform to act on my behalf. I acknowledge that this means Arrowform can access my ACC account in any way (including online and directly with ACC staff) and change ACC levy information held with the ACC on my behalf. I understand that by acting on my behalf, Arrowform will receive all correspondence from the ACC relating to me and will forward relevant correspondence to me electronically in the first instance until the process is completed.

Where this form is submitted on behalf of a person or entity other than myself personally, I warrant to Arrowform that I have the requisite authority to complete and submit this form on behalf of that entity/person, and bind them accordingly.

I acknowledge that this authority comes into force on the date that this form is processed by Arrowform. I acknowledge that Arrowform’s aim is to let me know whether or not I am due an ACC refund within three (3) working days of my application being processed. If I am due a refund, Arrowform will aim for me to receive it within six (6) to twelve (12) weeks of notifying me of such refund.

I acknowledge that by electronically submitting this form I authorise Arrowform to act on an ongoing basis for me as my ACC agent until I notify Arrowform of a cancellation of that authority. I acknowledge that the cancellation of this authority must be made in writing or by telephone to Arrowform. Cancellation will take effect once processed by Arrowform. Arrowform may decline to act or elect to cease to act for me by sending me notification in writing.

I understand that if I cancel this authority, I am still liable to pay fees owed to Arrowform in respect of any ACC refund resulting from any services provided, including any ACC invoice re-assessment submitted by Arrowform on my behalf.

I authorise Arrowform to undertake any inquiries it considers necessary.

I authorise Arrowform to promote its service by publishing my name or businesses name, region, industry and ACC refund value on the Levy Refunds website or for any advertising purpose. I agree to opt in for all email marketing correspondence related to Levy Refunds and understand that I can opt out at any time by contacting Levy Refunds directly or using an opt out link (if provided).

Fees and Refunds

I acknowledge that Arrowform will receive any refunds due to me on my behalf and are authorised to deduct any monies owed to Arrowform from such refunds.

I acknowledge that Arrowform will charge a service fee of 33% (GST-inclusive), of the gross value of any ACC refunds received. If I am not eligible for a refund, Arrowform will not charge me a fee.

I acknowledge that, except to the extent that I cancel the authority prior to the re-assessment being processed, I will be charged a fee for the ACC refund value resulting from re-assessment services provided by Arrowform.

I acknowledge that any credit issued to my ACC account as the result of an ACC invoice re-assessment requested by Arrowform and not refunded by the ACC due to an outstanding balance on my ACC account, will form the ACC refund value on which the fee is calculated.

Should my ACC refund be sent directly to me and not received directly by Arrowform to deduct their fees, I agree to compensate Arrowform for all fees owed to them within seven (7) days of receipt of an invoice. I acknowledge that I will also be responsible for meeting any costs incurred by Arrowform in the collection of unpaid fees.

Interest will accrue on any amounts (including costs) that I owe to Arrowform that are unpaid when due, at a rate of 15% per annum.

Privacy and Confidentiality

Arrowform ensures that all client information is held as private and confidential. Information collected in writing and/or verbally for ACC re-assessment services provided by Arrowform can be provided to the ACC for re-assessment or auditing purposes.

Where I have provided my driver licence, passport or other government-issued identification details to Arrowform as a form of identification, I consent to Arrowform validating the authenticity of those details through a third party, such as Equifax.

I understand that I have the right to request copies of all information about me that is held by Arrowform. I understand that I have the right to request Arrowform to correct any incorrect information about me which is held by Arrowform.

I acknowledge that the information provided by me will only be used for the purposes of determining eligibility for a refund under the Accident Compensation Act 2001 (and any law passed in substitution) and activities related to the processing of any such refunds. I acknowledge that Arrowform must comply at all times with any applicable provisions of the Privacy Act 1993 and the Official Information Act 1982. If Arrowform consider that I have breached these terms or any applicable law, Arrowform may provide my personal details as it sees fit to enable it or any third party to take court proceedings, enforce or apply its terms and conditions, or to protect any party’s rights, property or safety.

Statement of Disclaimer

I acknowledge and agree that:

  • Arrowform will not audit or review the information provided by me and therefore neither Arrowform, its agents or any of its employees accept any responsibility for the accuracy of the materials from which the ACC invoice re-assessment requests have been prepared.
  • Neither Arrowform, its agents or any of its employees accept any responsibility for the accuracy of my tax return information where this has been filed by my own tax agent.
  • Arrowform provides an ACC invoice re-assessment service and does not provide any financial advice related to financial products as defined under the Financial Advisers Act 2008.
  • I understand that the three (3) working day refund notification period and six (6) to twelve (12) week refund processing period are target time frames only for the work to be undertaken by Arrowform.

General

a) Intellectual Property Rights

Arrowform holds all copyright and other intellectual property rights in this website and the content on the website, unless the content is identified as being the property of someone else. You can reproduce (electronically or in hard copy) and use our content, but only for your personal use. In all other circumstances you must get our written consent before reproducing or otherwise using our content. If you wish to use any third party content identified as such on the website you must obtain the prior consent of the relevant owner.

b) Accessing the Website and Its Content

The website (and its content) is provided on an “as is” and “as available” basis. We reserve the right to withdraw or amend the website at any time, and do not guarantee that the website will be available to you at any time. The content of the website is subject to change without notice. We do try to make sure that the information on the website is accurate and up-to-date, but cannot guarantee that the content is reliable, accurate, or suitable for what you may want to use it for.

c) Your Use of the Website

You agree to use the website in a manner that complies with all applicable laws and does not infringe the rights of anyone else. In particular, you agree not to:

  • damage or harm the website, or any underlying or connected network or system;
  • introduce any content or code to the website which is technologically harmful;
  • upload any content on the website (or use the website to transmit any communication) which is illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise objectionable.

You indemnify us from and against all losses arising as a result of your breach of these terms.

d) Arrowform’s Liability

Arrowform will not be liable for any loss or damage (direct or otherwise) that you suffer in connection with your use of the website or your use of, or reliance on, content contained on or accessed through the website. We also exclude any condition or warranty that could be implied into these terms (but only to the extent permitted by law).

e) Security

Information transmitted over the internet is inherently insecure. We have physical and electronic processes in place to protect the information we collect via our website. Any information sent through the website is passed through a secure server using encryption technology, but cannot guarantee security.

You are responsible for taking all reasonable steps to:

  • prevent someone misusing or getting unauthorised access to your computer system or to any electronic signature or passwords you have to access the website; and
  • ensure your computer system and data are free of viruses and other forms of corruption.

f) Governing Law

The website and their terms and conditions are governed by the laws of New Zealand. When you access the website, you submit to the exclusive jurisdiction of the New Zealand courts.
